RELEASE OF LIABILITY, WAIVER OF CLAIMS, ASSUMPTION OF RISKS and INDEMNITY AGREEMENT (hereinafter referred to as the "Waiver Agreement")
ALL INDIVIDUALS PARTICIPATING IN ANY IN-PERSON OUR EVENT MUST READ, UNDERSTAND, AGREE TO AND SIGN THIS WAIVER AND DECLARATION. BY PARTICIPATING IN THIS EVENT, I, for myself and anyone entitled to act on my behalf, WAIVE AND RELEASE the event organizer, its members, board members, agents, sponsors, volunteers, their representatives, and successors from ALL CLAIMS, LIABILITIES, OBLIGATIONS, OR RESPONSIBILITIES for any cost, loss, damages of any form or type, or adverse consequence alleged to have happened directly or indirectly as a result of my participation in the event. These include but are not limited to my own acts or omissions as a result of any advice presented, provided, or discussed in this event. I waive my ability to bring any legal action against the entities outlined in this waiver and I waive all my rights and claims including the RIGHT to SUE the {organizer} and the entities outlined in this waiver.
I, hereby acknowledge that I am at least 18 years of age and agree to the terms outlined in this document:
a) I acknowledge that the novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization, and COVID-19 is extremely contagious.
b) I am attending or participating voluntarily in the in-person event and understand the risks associated with COVID-19. I agree to assume those risks, including but not limited to COVID-19, including exposure, being infected, and in the worst-case scenario death.
c) I acknowledge and assume all risks arising from participation in any capacity in any of organizer's in-person events, including but not limited to physical injury, loss of physical abilities of any kind, and death.
d) I agree that by participating in this event, I grant the event organizer and its authorized representatives full rights to use my name, likeness, PERSONAL DATA provided during registration and post-event reporting as well as the images resulting from the photography/video filming, and any reproductions or adaptations of the media for fundraising, publicity or other purposes to help achieve the group’s aims. This might include (but is not limited to), the right to use them in their printed and online publicity, social media, and promotional material. If you do not wish to be photographed/filmed, please let an event organizer know.
I, hereby acknowledge that I am at least 18 years of age and agree to the terms outlined in this document:
1) To ASSUME all risks arising out of, associated with, or related to the individual participant’s participation in any in-person event organized by the event organizer, all board members, affiliates, volunteers, representatives, and successors.
2) To WAIVE all claims that the individual may have now or in the future against the event organizer, all board members, affiliates, volunteers, representatives, and successors.
3) To freely ACCEPT AND FULLY ASSUME all such risks and possibility of personal injury, death, property damage, expense, and related loss, including loss of income, resulting from the individual’s participation in the organizer's in-person event.
4) To FOREVER RELEASE and INDEMNIFY the event organizer, all board members, affiliates, volunteers, representatives, and successors from any and all liability for any and all claims, demands, actions, damages (including direct, indirect, special, and/or consequential), losses, actions, judgments, and costs (including legal fees) (collectively, the “Claims”) which the individual has or may have in the future, that might arise out of, result from, or relate to the individual participant’s participation in the organizer’s in-person event, even though such Claims may have been caused by any manner whatsoever, including but not limited to, the negligence, gross negligence, negligent rescue, omissions, carelessness, breach of contract and/or breach of any statutory duty of care of the event organizer, all board members, affiliates, volunteers, representatives, and successors.
5) To FOREVER RELEASE AND INDEMNIFY the event organizer, all board members, affiliates, volunteers, representatives, and successors from any action related to the individual becoming exposed to or infected by COVID-19 as a result of, or from, any action, omission or negligence of the individual or others, including but not limited to the event organizer.
6) In entering into this Waiver Agreement, I am not relying on any oral or written representations or statements made by the event organizer, all board members, affiliates, volunteers, representatives, and successors with respect to the safety of participating in the in-person event, other than what is set forth in this Waiver Agreement.
7) I confirm that I have read and have had sufficient time to read each term of this Waiver Agreement, have understood the terms of this Waiver Agreement, and AGREE TO BE BOUND by the terms of this Waiver Agreement.
8) This release, waiver, and indemnity agreement is intended to be as broad and inclusive as is permitted by law of the Province of Ontario and if any portion thereof is held invalid, the balance shall notwithstanding, continue in full legal force and effect.
I HAVE READ AND UNDERSTAND THIS WAIVER, I AFFIRM THAT I AM AT LEAST 18 YEARS OF AGE, AND I AM AWARE THAT BY ACCEPTING THIS WAIVER I AM GIVING UP CERTAIN SUBSTANTIAL LEGAL RIGHTS INCLUDING THE RIGHT TO SUE.
